1. Acceptance of Terms
By accessing the Nursico website, submitting a service inquiry, signing a service agreement, or receiving care from any Nursico nursing professional, you affirm that you have read, fully understood, and unconditionally agreed to be bound by these Terms & Conditions in their entirety. This agreement is a legally binding contract between you (the ‘Client,’ ‘Patient,’ or ‘User’) and Nursico. If you are entering into this agreement on behalf of a minor, dependent, or another individual for whom you serve as a legal guardian or healthcare proxy, you represent and warrant that you have the legal authority to bind that individual to these terms. By accepting this Agreement, you also confirm that you are at least 18 years of age, or that you are acting as a duly authorized legal guardian. If you do not agree with any provision of these Terms & Conditions, you are not authorized to use our services, and you should immediately cease accessing our website and contact us to discuss alternative arrangements. Your continued use of Nursico’s services following any notification of changes to this Agreement constitutes your acceptance of those changes.
2. Services Provided
Nursico provides a comprehensive range of professional nursing and healthcare support services delivered by licensed, credentialed, and insured nursing professionals. Our service offerings include, but are not limited to: in-home skilled nursing care for acute and chronic conditions; post-surgical recovery and wound care management; chronic disease monitoring and management programs for conditions including diabetes, hypertension, heart failure, COPD, and renal disease; pediatric nursing services including developmental assessments and specialized clinical monitoring; geriatric nursing care with a focus on functional independence, fall prevention, and dignity-centered support; intravenous (IV) therapy and infusion services administered in home settings; medication management, administration, and patient education; hospice support and palliative care coordination; and professional nurse staffing placements for hospitals, clinics, rehabilitation centers, assisted living facilities, and other healthcare organizations. All services are subject to prior clinical assessment, geographic service area availability, nurse credentialing requirements, and applicable state and federal licensing regulations. Nursico reserves the right to modify, expand, or discontinue any service offering at any time with reasonable advance notice to affected clients.
3. Eligibility and User Responsibilities
To be eligible to use Nursico’s services, you must be an individual of at least 18 years of age, or a legal guardian or authorized healthcare representative acting on behalf of a minor, dependent, or legally incapacitated individual. You are responsible for ensuring that all information provided to Nursico — including personal identification details, health history, medication lists, insurance information, and care preferences — is accurate, complete, and updated promptly whenever changes occur. You acknowledge that providing false, incomplete, or misleading information to Nursico may compromise the safety and quality of the care provided, and may constitute a material breach of this Agreement. As a client or patient, you agree to cooperate fully with your assigned nursing professional by following the agreed care plan, adhering to scheduled care appointments, communicating openly about changes in your health status, and creating a safe and respectful environment for care delivery in your home or designated care setting. You also acknowledge that you are responsible for understanding your own healthcare coverage and for meeting any financial obligations associated with the services you receive, regardless of insurance status or billing disputes.
4. Appointment Scheduling and Cancellations
All nursing service appointments must be scheduled through Nursico’s care coordination team by telephone, email, or through our online booking portal, subject to nurse availability and clinical assessment requirements. Once an appointment has been confirmed, it represents a binding commitment on the part of both Nursico and the client. We recognize that circumstances can change unexpectedly, and we have established the following cancellation and rescheduling policy to balance operational planning with client flexibility. Cancellations or rescheduling requests made more than 24 hours prior to the scheduled service time will be processed at no additional charge, and we will make every effort to accommodate your preferred alternative schedule. Cancellations made within 24 hours of the scheduled service time may be subject to a late cancellation fee, which will be communicated to you at the time of service agreement. No-shows — defined as failure to be present or available for a confirmed appointment without prior notification — will be treated as missed appointments and may be subject to applicable charges. Nursico reserves the right to reschedule or cancel appointments due to staff illness, clinical emergencies, inclement weather, or other circumstances beyond our control, and we commit to providing the maximum reasonable advance notice and to rescheduling affected appointments as promptly as possible.
5. Fees, Billing, and Payment
Nursico’s service fees are established based on the nature and complexity of the nursing care required, the level of licensure of the assigned nursing professional, the frequency and duration of care, and any applicable state or regional pricing standards. All applicable fees, including any one-time assessment charges, hourly or per-visit rates, and potential surcharges for after-hours, weekend, or emergency services, will be clearly communicated to you in writing prior to the commencement of any service engagement. Nursico issues invoices in accordance with the billing schedule outlined in your service agreement, and payment is due upon receipt unless alternative terms have been agreed in writing. We accept payment via major credit and debit cards, electronic bank transfer (ACH), checks, and certain digital payment platforms as disclosed during enrollment. Accounts that are more than 30 days past due may be subject to a late payment fee of 1.5% per month on the outstanding balance, and Nursico reserves the right to suspend services for accounts with significant unpaid balances until the account is brought current. For clients utilizing health insurance benefits, we will work diligently to submit claims accurately and on time; however, the client remains ultimately responsible for any amounts not covered by their insurer, including deductibles, co-payments, co-insurance, and non-covered services.
6. Scope of Clinical Care
All nursing services provided by Nursico are delivered within the established scope of practice defined by the licensing body of the State of Texas, the American Nurses Association (ANA) standards of practice, and the specific credentials and certifications held by the individual nursing professional assigned to your care. Nursico’s nurses deliver clinical care in accordance with the individualized care plan developed in consultation with you and your physician or other authorized healthcare provider. Our nursing professionals are not authorized to independently diagnose medical conditions, prescribe medications, order diagnostic tests, or make clinical determinations that fall outside the defined scope of nursing practice, except where specifically licensed and authorized to do so by applicable state law. Any changes to your prescribed medication regimen, treatment plan, or diagnostic approach require authorization from your attending physician or specialist. In the event of a medical emergency, our nurses are trained and prepared to initiate emergency protocols, including cardiopulmonary resuscitation (CPR) and basic life support (BLS), while simultaneously summoning emergency medical services by calling 911. We strongly advise all clients to maintain up-to-date contact information for their primary care physician, specialists, and local emergency services in their care record with Nursico.
7. Client Obligations and Cooperation
A successful nursing care relationship is built on mutual cooperation, open communication, and mutual respect. As a Nursico client, you commit to fulfilling the following obligations for the duration of your service engagement: You will provide and maintain a safe, clean, and reasonably accessible environment in which our nursing professionals can deliver care, including ensuring that any equipment or supplies specified in your care plan are available and in working order. You will provide complete, accurate, and current medical history, medication lists, allergies, and other health information at the time of initial assessment and will promptly notify Nursico of any significant changes in your health status or care needs. You will make your best effort to adhere to the agreed care schedule by being present and prepared for all confirmed nursing visits. You will treat all Nursico nursing professionals, care coordinators, and administrative staff with courtesy, dignity, and professional respect at all times. You will not request that our nursing professionals perform tasks or procedures that fall outside their authorized scope of practice, or that are inconsistent with the agreed care plan. Failure to meet these obligations may, at Nursico’s discretion, result in a formal notice of concern, modification of the care plan, temporary suspension of services, or permanent termination of the service agreement, depending on the nature and severity of the situation.
8. Limitation of Liability
To the maximum extent permitted under applicable law, Nursico’s total liability to any client or third party arising from or related to the provision of nursing services, the use of our website, or any other matter governed by this Agreement shall be limited to the total amount paid by the client to Nursico for the specific service or services giving rise to the claim during the three (3) months immediately preceding the event that caused the damage or loss. Nursico shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of income, loss of data, emotional distress, or any other economic or non-economic losses, even if Nursico has been advised of the possibility of such damages. This limitation applies regardless of the legal theory under which the claim is brought, whether in contract, tort, negligence, strict liability, or otherwise. Nothing in this limitation of liability shall apply to or limit Nursico’s liability for: death or personal injury resulting directly from our gross negligence or willful misconduct; fraudulent misrepresentation; any other liability that cannot be legally excluded or limited under applicable law, including claims arising under HIPAA or applicable state healthcare regulations. Clients are encouraged to maintain adequate personal healthcare insurance coverage to protect against losses that may not be recoverable from Nursico.
9. Termination of Services
Either party — Nursico or the client — may terminate the nursing services agreement at any time by providing reasonable written notice to the other party. For planned terminations, Nursico requests a minimum of seven (7) days’ written notice from the client to allow for proper care transition planning, including coordination with the client’s physician and any receiving care provider. Nursico will provide the same minimum notice for planned service terminations initiated by our organization, except in circumstances requiring immediate action. Nursico reserves the right to terminate any service agreement immediately and without prior notice in the following circumstances: a client or household member engages in abusive, threatening, or harassing behavior toward any Nursico employee or contractor; a client fails to maintain a reasonably safe care environment despite written notice and reasonable opportunity to remedy the situation; a client’s account is significantly delinquent and payment arrangements cannot be agreed upon; a client provides materially false or misleading information that affects care safety or legal compliance; or regulatory, licensing, or legal requirements prevent the continuation of services. Upon termination, any outstanding balance for services rendered will remain due and payable in full. Nursico will provide a summary of care and transfer of records to the client’s designated provider upon request.
10. Amendments to These Terms
Nursico reserves the full right to amend, revise, update, or replace these Terms & Conditions at any time, at its sole discretion, in response to changes in applicable law, regulatory requirements, industry standards, business practices, or service offerings. When changes are made to these Terms, we will revise the ‘Last Updated’ date at the top of this document and publish the updated version on our website. For changes that are material in nature — meaning they substantially affect your rights, obligations, or the scope of services covered — we will take additional steps to notify you, which may include sending a notification to the email address on file for your account, displaying a notice on our website, or including a notice with your next service confirmation. We encourage you to review these Terms & Conditions regularly to stay informed of any updates. If you disagree with any changes to these Terms, you have the right to terminate your service agreement by providing written notice to Nursico as described in the Termination of Services section above. Your continued use of Nursico’s services after changes have been published or communicated will constitute your acceptance of the revised Terms in full.
